Terms and Conditions

Terms governing the use of ByteShelf products, services, and website

1. Introduction

Welcome to ByteShelf. These Terms and Conditions govern your use of the ByteShelf website, digital products, eBooks, guides, and Shopify and WordPress development services.

By accessing our website, purchasing a digital product, or purchasing a development package, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree with these terms, please do not use our website or purchase our products and services.

2. Intellectual Property Rights

Unless otherwise stated, ByteShelf and its licensors own all intellectual property rights relating to the content, materials, designs, resources, eBooks, guides, graphics, text, and other materials available through our website.

When you purchase a digital product from ByteShelf, you receive a limited, non-exclusive, non-transferable license to use the purchased material for your personal use or internal business purposes.

You may not copy, reproduce, redistribute, publish, resell, sublicense, upload, share, or commercially distribute ByteShelf digital products or any portion of them without our prior written permission.

3. Web Development Services

ByteShelf provides fixed-price Shopify and WordPress development packages as described on our website.

Full payment is required before development work begins.

The project scope, expected deliverables, features, and applicable requirements will be based on the package selected and any additional requirements agreed upon between ByteShelf and the client.

Project timelines may depend on the complexity of the work, client communication, approvals, feedback, and the timely provision of required content, credentials, images, product information, or other assets.

Delays in providing required information or feedback may affect the estimated project completion timeline.

4. Project Scope and Additional Work

Development services are provided according to the selected package and agreed project scope.

Requests for additional pages, features, integrations, functionality, revisions, custom development, or other work outside the original scope may require additional charges.

Additional work will generally be discussed and agreed upon before it is carried out.

5. Client Responsibilities

The client is responsible for providing accurate information, required content, assets, access credentials, approvals, and other materials necessary for the completion of the project.

The client is also responsible for ensuring that any content, images, trademarks, products, or other materials supplied to ByteShelf are legally permitted for use.

ByteShelf is not responsible for delays caused by missing information, delayed feedback, unavailable access, or other circumstances outside our reasonable control.

6. Digital Products and Purchases

All eBooks, guides, templates, and other digital products sold through ByteShelf are delivered electronically.

Depending on the product and checkout process, access to the purchased digital product may be provided immediately after successful payment.

Because digital products may be accessed or downloaded immediately, digital product purchases are generally final and non-refundable once access or download has been provided, subject to applicable consumer protection laws.

7. Digital Product Usage

Purchased digital products are licensed to the purchasing customer and are intended for personal use or internal business use.

You may not:

  • Resell or redistribute our digital products
  • Share download links with unauthorized persons
  • Upload our eBooks or guides to public websites
  • Reproduce or republish the content
  • Sell modified or copied versions
  • Share purchased files through unauthorized third-party platforms
  • Claim ByteShelf content as your own

Unauthorized distribution or commercial use of ByteShelf digital products may result in termination of access and other remedies available under applicable law.

8. Website and Service Availability

We make reasonable efforts to keep the ByteShelf website and services available and functioning properly.

However, we do not guarantee that the website, digital downloads, or services will always be available, uninterrupted, error-free, or free from technical issues.

Temporary interruptions may occur due to maintenance, hosting issues, third-party services, technical problems, or circumstances beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ByteShelf will not be responsible for indirect, incidental, consequential, special, or other losses arising from the use of our website, digital products, or development services.

This may include loss of profits, revenue, business opportunities, data, or other indirect losses.

Nothing in these Terms and Conditions is intended to exclude or limit any liability or consumer rights that cannot legally be excluded or limited under applicable law.

10. Third-Party Services

Our development services may involve third-party platforms, applications, plugins, hosting providers, payment processors, APIs, themes, or other external services.

ByteShelf is not responsible for changes, interruptions, limitations, pricing, policies, security issues, or availability of third-party services that are outside our reasonable control.

11. Changes to These Terms

ByteShelf reserves the right to update or modify these Terms and Conditions from time to time.

Any updated version will be published on this page with a revised "Last Updated" date.

Your continued use of the website or services after changes have been published may constitute acceptance of the updated terms, to the extent permitted by applicable law.

12. Governing Law

These Terms and Conditions shall be interpreted and applied in accordance with applicable laws and regulations.

Any rights you have under mandatory consumer protection laws remain unaffected by these Terms and Conditions.
